Horoshak is charged with: - One count of Grand Larceny in the Third Degree, a class “D” Felony Between May, 2007 and February, 2008, Horoshak told his friend, Anthony Capasso of Congers, that a lawsuit against his divorce attorney had been settled for $10.3 million dollars. The defendant promised to give Capasso a portion of the settlement proceeds in the future. Horoshak provided a forged ‘Satisfaction of Judgment’ to Capasso, showing that he received the multimillion dollar settlement. The defendant then began to borrow money from the victim with the promise to repay him with lawsuit money. Horoshak also produced two other phony documents to the victim in order to continue to borrow money from him during the course of several months. After failing to receive any payments from Horoshak, the defendant contacted prosecutors in the Rockland County District Attorney’s Office. In the end, defendant stole $41,205 from Capasso under false pretenses, thus ending a 15year friendship. Horoshak was arrested Wednesday after surrendering during a visit with his probation officer. He was arraigned in the Town of Clarkstown Justice Court by the Honorable Scott Ugell. Bail was set in the amount of $5,000. His next court appearance date is October 9th, 2009. Horoshak faces up to seven years in state prison. This case was investigated by the Special Investigations Unit of the Rockland County District Attorney’s Office. Senior Assistant District Attorney Ameenah Karim will prosecute the case.
